Probate and Estate Administration
The Loftin Firm LLP attorneys represent clients petitioning for probate or a probate contest, trustees of trusts, and beneficiaries of instruments that pass title outside of probate. Our probate attorney services are enhanced by a full team who can respond in specific, related areas, including, contracts, real estate, tax issues, and litigation. While most estate planning today passes title for assets outside of probate, there are many situations where a probate petition may be unavoidable.
Conservatorships for Vulnerable Adults
As part of our probate practice, our attorneys represent clients in probate conservatorships. A conservatorship is a legal proceeding where a responsible person is appointed to care for another, by a California Court. The focus is to ensure the vulnerable "conservatee" and their finances are cared for by the conservator. Depending on the seriousness of the vulnerability, in probate this can be either a limited conservatorship or a general conservatorship. There are also special mental health conservatorships known as Lanterman-Petris-Short Conservatorships. These are initiated by a government agency and focused on restrictive living arrangements- and are different from probate conservatorships.
